These Terms & Conditions govern your use of HaKi Check-In at hakicheckin.com (the "Service"), provided by HaKi Energy Systems LLC ("HaKi"). By using the Service you agree to these terms.

The Service

HaKi Check-In lets athletes and staff rate their energy before practices and games, and lets coaches and administrators see that information according to their role. HaKi is a performance and awareness tool. It is not medical, mental-health or emergency care. If someone may be in danger, contact emergency services or a qualified professional.

Accounts

You are responsible for the accuracy of the information you provide and for activity under your account. Organizations and coaches who purchase the Service are responsible for inviting only people they are authorized to add, and for obtaining any permissions their school or organization requires.

SMS Terms

• Program: HaKi Check-In text messages, sent by HaKi Energy Systems LLC.
• What you'll receive: one-time sign-in codes when you sign in with your mobile number; check-in reminders when your team's pre-practice or pre-game check-in opens and 5 minutes before it closes; and, for coaches, alerts when an athlete on their team checks in with very low energy or asks to talk, plus a reminder after practice to rate the session. HaKi Check-In texts are never used for marketing.
• Frequency: message frequency varies with your team's schedule, typically 2–3 messages per practice or game.
• Cost: Message and data rates may apply.
• Opt out: reply STOP to any message to stop receiving texts. You'll get one confirmation message and no further texts unless you opt in again.
• Help: reply HELP to any message, or email ben@hakienergy.com.
• Carriers: carriers are not liable for delayed or undelivered messages.
• Consent: agreeing to receive texts is not a condition of purchase or of using HaKi; you can use the Service by email instead.
• Privacy: see our Privacy Policy. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.

Acceptable use

Don't misuse the Service: no attempts to access other people's data, to disrupt the Service, or to use it to harass anyone.

Fees

Organizations and coaches who purchase the Service pay the fees shown at purchase. Athletes and parents are not charged by HaKi.

Disclaimers and liability

The Service is provided "as is." To the extent allowed by law, HaKi is not liable for indirect or consequential damages, and our total liability is limited to the amount paid for the Service in the 12 months before the claim.
